Most land buyers often ask to see the title deed before buying land. However, a majority lose their hard-earned money in the process despite getting the document.
According to Solomon Wangwe, a real estate developer, the title deed can be considered a “useless” document in such cases.
Wangwe says TSWT often forget to look for other relevant documents that complete the land purchase process and focus on the title deed, which can be forged.
Among the most important documents to be analyzed are a mutation form (in case the land was part of a large parcel), an index card and a green card.
1. Consult a lawyer
Wangwe argued that TSWT are ignoring the importance of involving a licensed lawyer in the land purchase process.
“I advise TSWT to hire a qualified lawyer when purchasing land. The lawyer can check the legality of the title deed.
“Also make sure he is certified, an unlicensed lawyer can make you a lot of money,” he argued.
2. Failure to check the title deed online
Through the e-citizen platform and the Ardhisasa platform, land buyers can validate their title deeds online
On these platforms, all you need to do is enter your title details and the system will roll back the feedback.
3. Not knowing the different types of title deeds
There are three main types of title deeds sectional (shows ownership of a single unit in a building), leasehold (shows ownership of land with a maximum of 99 years), and ownership (shows ownership of land with no restrictions).
It is wise to understand the difference in the title deeds.
4. Cannot distinguish between false and real title deeds.
Consult a professional such as a lawyer to verify the authenticity of the title deed. Yoyou can also go to the Land Registry to check if the title deed is registered
Be sure to confirm the location of the plot of land or real estate you are purchasing.
Check the identity and background of the company or person from whom you are buying land.
5. Incorrect names
If you have a different name or nickname on the title deed, you can invalidate your land tenure.
Make sure your names match those other government documents.
Other errors made in the title deed include incorrect amount of compensation, lack of notary stamp and subscribed witnesses, faulty confirmations or missing witnesses, lack of acknowledgment and marital status of donors on a non-homestead affidavit, and failure to obtain the combination of the donor’s spouse on the leasehold deed.
